This layer contains information pertaining to specific parcels that have been purchased with Florida Forever or ARPA funds. Description: Conservation Easements are less-than-fee simple purchases of limited property rights (as opposed to fee simple, which is the purchase of lands outright). Only those easements tracked by FNAI and included in the Florida Conservation Lands database are shown.
For a less-than-fee property to be tracked by FNAI, the conservation easement must be permanent (i.e., held “in perpetuity”) and regularly monitored by an agency or organization knowledgeable about conservation in order to assure protection of the natural resources.
Acquiring land at less-than-fee simple means acquisition of an interest in the property which allows the purchasing agency or organization to conserve and protect resources on the property at less cost while keeping the land in private ownership. A conservation easement is placed on property acquired less-than-fee.
Less-than-fee acquisitions are an increasingly important part of land protection efforts in Florida. This acquisition method provides agencies and organizations a way to achieve specific conservation objectives on the land while keeping the land in the ownership and control of landowners for uses consistent with the conservation objectives.
Description: Aquatic Preserves are state-owned sovereign submerged lands in areas which have exceptional biological, aesthetic, and scientific value, as described in Chapter 258.39, Florida Statutes, which have been set aside for the benefit of future generations. These areas are managed by the Florida Department of Environmental Protection's Office of Coastal and Aquatic Managed Areas. However, it is important to note that there are three Aquatic Preserves whose OFW boundaries differ from the Aquatic Preserve boundary. These are described more specifically in the OFW rule 62-302.700: Indian River - Malabar to Vero Beach - does not include portions of Sebastian and Turkey creeks; Wekiva River - does not include portions of the St. Johns River; and Big Bend Seagrasses - the OFW rule specifies certain "incorporated and unincorporated areas" that are excluded from the Aquatic Preserve.
